Terms of Service — Swan Safe Plus

The Swan Safe Plus Service ("SSP Service") is an optional security feature that requires an additional video verification step to access Bitcoin and USD withdrawals, as an enhancement to the verification processes outlined in the Swan Terms of Service. By accepting these Swan Safe Plus Terms of Service and using the SSP Service, you acknowledge and agree to how the SSP Service works. This is an addendum to the Swan Terms of Service and all terms therein also apply to the SSP Service, including but not limited to sections on fees, disclaimers, limitation of liability, and dispute resolution. The Swan Terms of Service are incorporated by reference and made a part of these Swan Safe Plus Terms of Service. In the event of any conflict between these Swan Safe Plus Terms of Service and the Swan Terms of Service, these Swan Safe Plus Terms of Service will control solely with respect to the subject matter described herein.

The SSP Service requires an additional verification step via a video call to access certain account features, including but not limited to Bitcoin and USD withdrawals. We will offer reasonable alternatives to video calls where required by law (e.g., for accessibility). These verification steps are completed by the client and serve to further secure and facilitate the client’s Bitcoin and USD withdrawals. Verification data, including video recordings, is handled in accordance with our Privacy Policy, incorporated herein by reference.

The SSP Service is not a guarantee, insurance product, warranty, or indemnity for the client’s Bitcoin, USD, withdrawal addresses, wallets, keys, or any other client-controlled information or device. It does not ensure or promise reimbursement or recovery in the event of a loss.

The SSP Service provides additional verification that takes additional time, and as such, the time to withdraw Bitcoin or USD may extend beyond comparable withdrawal times. If an attack on your Bitcoin or USD is suspected (e.g., based on anomalous activity, user reports, or security alerts), we may extend the verification time up to thirty (30) business days to fully resolve the issue, subject to applicable laws such as Regulation E for electronic fund transfers. Swan will make commercially reasonable efforts to resolve such issues promptly but will not be liable for delays resulting from fraud prevention, verification, or regulatory compliance procedures.

The SSP Service is a paid, optional service. Fees are calculated daily based on the average value of assets under custody with your custodian and charged monthly, as detailed at https://www.swanbitcoin.com/fees. By enrolling in SSP Service, Client acknowledges and agrees to the applicable fees as displayed or confirmed during enrollment.

The user may at any time end the SSP Service via the Swan website, through their account settings, or by emailing support@swanbitcoin.com. Termination of the SSP Service requires video verification, with alternatives available upon request. As a security measure, service termination is not complete until after the final verification step.  

Both the client and Swan shall at all times endeavor to act in a manner we reasonably deem prudent and commercially reasonable at the time.

Swan Safe Plus is optional and available only to eligible clients per Section 1 of the Swan Terms of Service. Among other important terms, use is subject to sanctions compliance (per Section 12 of the Swan Terms of Service) and may not be available in all jurisdictions.

The SSP Service is provided on an “as is” and “as available” basis.  Swan makes no warranty that the service will prevent unauthorized access or guarantee the safety of client’s Bitcoin, wallets, or private keys.  To the fullest extent permitted by law, Swan disclaims all express or implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.  Swan’s total liability under these Swan Safe Plus Terms of Service shall not exceed the total SSP Service fees paid by Client during the twelve (12) months preceding the event giving rise to the claim.  Swan shall not be liable for any indirect, incidental, consequential, special, or punitive damages.

Swan may modify, suspend, or discontinue the SSP Service at any time.

Material changes will be communicated at least thirty (30) days in advance via email or in-app notice.  Continued use of the SSP Service after notice constitutes acceptance of the modified terms.  For security-critical updates, we may implement changes immediately with subsequent notification.
